What we deliver, how billing, cancellation and annual renewal work, what you confirm when you authorize an audit, and who owns the evidence.

About these terms

SalesWitness is operated by [entity name and registration to be inserted].

These terms apply when you enroll, use the client portal or buy any SalesWitness service. By enrolling you accept them on behalf of your business. Our privacy policy explains how we handle personal information.

The service

We mystery-shop your business’s own sales channels — inquiry form, email inquiry, live chat, WhatsApp and phone call, as your plan includes — as an ordinary prospect, and score how each one responds, with the evidence attached. We also check your website and watch your public review profiles. Results appear in your client portal and by email.

  • SalesWitness Audit (the Revenue Leak Audit) — a one-time audit of your channels, with a written report.
  • SalesWitness Watch and SalesWitness Watch Pro — recurring plans: audits at your plan’s frequency plus daily review monitoring. Watch Pro adds a competitor benchmark.
  • Custom and multi-site packages — as set out in the quote you accept.

What each plan includes, and its price, is what our pricing page (or your quote) shows when you enroll. Inquiries are made using a shopper persona; some channels, such as phone calls, may use an AI-generated voice.

An audit is a sample of how your business responded during the audit window. It is evidence to act on, not a guarantee of sales, and not legal or employment advice.

Enrollment and authorization

The person who enrolls must be the owner or an authorized officer of the business and sign the audit authorization. Nothing runs until that authorization is on file. You can withdraw it at any time by contacting us; we then stop all audits, and any plan ends as described below.

Fees and invoices

Paid by invoice for now while card payments are being connected — there is no free trial; the audit and every plan are chargeable. Your invoice is issued when you enroll. Invoices are payable as stated on them; if you pay by card, Stripe processes the payment. Prices are shown in your currency.

SalesWitness Audit is a one-time purchase.

Monthly plans

Monthly plans run month to month. You can cancel at any time, and we won’t invoice you for any month after you cancel.

Annual plans

  • Annual billing is invoiced once a year, at the annual price shown when you enroll.
  • It renews for another year on the renewal date unless you cancel before that date. If you cancel in time, it simply doesn’t renew.
  • We don’t refund a year that has started. The exception: if we fail to deliver the audits your plan includes, we refund the part of the annual fee that covers the audits we didn’t deliver.

What you confirm

When you authorize an audit, you confirm that:

  • You own, or are authorized to act for, the business and every channel you ask us to shop, and you have the authority to let us contact those channels as a prospect.
  • Recording calls and chats with your business, as the authorization describes, is lawful where your business and its staff operate — including any notice or consent the law there requires.
  • You are responsible for informing your staff about the audits and recordings where local law requires it.
  • The information you give us is accurate, and you will use the findings lawfully, including in any staff process.

Acceptable use

You agree not to:

  • Ask us to shop any business you don’t own or control, apart from the competitor benchmark your plan includes.
  • Ask us to post, buy or solicit reviews, to report reviews falsely, or to contact anyone while presenting ourselves as you.
  • Share portal access with people outside your business, or try to access other clients’ data.
  • Copy, resell or reverse-engineer the service, or use it to build a competing one.

We may pause the service if these terms are broken or invoices go unpaid, and we will tell you why.

Evidence and intellectual property

Your reports and the evidence behind them are yours to use for your business: share them with your team, advisers and anyone else you choose. Our software, scoring method, report design and personas remain ours.

We may use anonymized, combined results — for example typical response times in an industry — to build benchmarks. These never identify your business or any person. Reviews belong to their authors and the platforms that host them.

Liability

We run every audit with care, but we can’t guarantee that every channel will respond during the audit window or that the service will always be uninterrupted.

Our total liability to you for anything arising from the service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect losses or lost profits. Nothing in these terms limits liability that the law does not allow to be limited.

Changes to these terms

When we change these terms we update the date at the top and email our clients about any change that affects them.

Governing law

These terms are governed by the laws of [jurisdiction to be inserted — where the operating entity above is registered], and its courts have jurisdiction over any dispute.
